Alleged Lavish Lounge Shooter Indicted on Unrelated Loaded Firearm Charge

Auburn, NY - Acting District Attorney Brittany Grome Antonacci announced today that ANTOINE CLARK, 38, of Rochester, New York, was indicted by a Cayuga County Grand Jury on one count of Criminal Possession of a Weapon in the Second Degree, in violation of Penal Law Section 265.03[3], a Class C Armed Violent Felony; and two counts of Criminal Possession of a Controlled Substance in the Third Degree, both Class B Felonies. The indictment alleges that on July 25, 2022, CLARK possessed a loaded and operable 9 mm pistol while in the area of North Seward Avenue in the City of Auburn. The indictment further alleges that defendant was found in possession of more than ½ ounce of the narcotic drug cocaine, and that he possessed the cocaine with the intent to sell it.  CLARK faces up to a fifteen (15) year determinate prison sentence, followed by 5 years of post-release supervision if convicted.


Defendant was arraigned before the Centralized Arraignment Part and remanded to the County Jail without bail. Arraignment on the indictment will be held before the Honorable Thomas G. Leone in Cayuga County Court at a date to be determined.


Unrelated to the present offense, defendant was also charged by the Auburn Police Department with one count Assault in the First Degree, one count of Criminal Possession of a Weapon in the Second Degree, and one count of Criminal Use of a Firearm, for his alleged role in the shooting outside of Lavish Lounge on Genesee Street on June 26, 2022. Defendant was arraigned on those charges and remanded without bail pending Grand Jury action.


“In an effort to combat both the increase in crime and gun violence, the District Attorney’s Office is prioritizing the prosecution and Grand Jury presentment of violent felony offenders. We have increased our efforts to diligently secure indictments on violent felony offenders within weeks of their arrest. Our Office will no longer engage in plea bargains on violent felony offenses prior to indictment.”


All charged individuals are presumed innocent until proven guilty
