Convicted Felon Sentenced For Possession Of Stolen Assault Rifle And Heroin

Deputy Chief Assistant District Attorney Brittany Grome Antonacci announced today that FLOYD CHAVIS, 39, of Syracuse, was sentenced today after a January 14, 2020 guilty verdict following a week-long jury trial to the maximum term of incarceration of 12 years determinate, followed by 3 years of post-release supervision on the (1) Count of Criminal Possession of a Controlled Substance in the Third Degree, a Class B Felony; 7 years determinate, followed by 5 years of post-release supervision on the (1) count of Criminal Possession of an Assault Weapon in the Third Degree, a Class D Violent Felony; an indeterminate term of 2 to 4 years on the (1) count of Criminal Possession of Stolen Property in the Fourth Degree, a Class E Felony; and time served on each count of Criminally Using Drug Paraphernalia in the Second Degree, Class A Misdemeanors. All sentences were directed to run concurrently by operation of law.


After hearing testimony and reviewing evidence, the jury concluded that on February 19, 2019, while in the area of 51 Orchard Street, in the City of Auburn, CHAVIS was taken into custody by members of the Auburn Police Department and the Finger Lakes Task Force following an active investigation into synthetic molly sales at that residence. During the search of the residence, Task Force members recovered more than four and a half bundles of heroin, numerous controlled substances, multiple bb guns, and digital scales in defendant’s bedroom. The jury concluded that defendant possessed the heroin with the intent to sell it. Law enforcement also recovered a stolen assault weapon in the attic area, which was only accessible through defendant’s bedroom. The assault weapon was determined to be stolen from a storage facility in Onondaga County, specifically the Skaneateles area. CHAVIS was determined to be the major contributor of DNA on the stolen weapon.


The sentencing was delayed for two years due to COVID and repeated adjournment requests by the defendant.


This case was prosecuted by Deputy Chief Assistant District Attorney Brittany Grome Antonacci.

I’d like to commend the Finger Lakes Task Force and Auburn Police Department for their proactive role in combating the sale of deadly narcotic drugs and for their support in protecting our community.”
