Defendant Admits to Sexually Assaulting Woman on Eve of Trial

Auburn, NY - District Attorney Brittany Grome Antonacci announced today that Brandon LOWE, 37, of the City of Auburn, pled guilty to the entire indictment before the Honorable Thomas G. Leone. The indictment was comprised of the following charges: Burglary in the Second Degree, a Class D Violent Felony; Attempted Rape in the First Degree, a Class C Violent Felony; Sexual Abuse in the First Degree, a Class D Felony; two counts of Criminal Contempt in the First Degree, Class E felonies; Criminal Contempt in the Second Degree, a Class A Misdemeanor, Criminal Trespass in the Second Degre a Class A Misdemeanor,  and Harassment in the Second Degree, a violation.  Trial was scheduled to start in this case on October 2, 2023.  The defendant is expected to be sentenced on January 4, 2024 to an eight (8) year determinate term in prison with nine (9) years of Post-Release Supervision. The District Attorney’s Office will recommend a ten-year determinate sentence, followed by ten years of post-release supervision at the time of sentencing.

 

During the plea, LOWE admitted to sexually assaulting the victim and leaving her harassing voice messages over a period of days leading up to the sexual assault, all in violation of a full stay away order of protection.  Thanks to a 911 call from a third party, who reported the order of protection violation, members of the Auburn Police Department quickly responded to victim’s home and were able to apprehend LOWE during the assault.

 

Senior Assistant District Attorney Heather De Stefano prosecuted this case. The investigation was handled by members of the Auburn Police Department.
