Former ACF Inmate Pleads Guilty to Assaulting Correction Officers

Auburn, NY - District Attorney Brittany Grome Antonacci announced today that DEJOUR NESMITH, 32, of Rochester, New York pled guilty before the Honorable Jon E. Budelmann to three counts of Attempted Assault in the Second Degree, Class E Felonies, arising from an incident in the north mess hall of Auburn Correctional Facility on August 10, 2022.

 

NESMITH entered a guilty plea to (3) counts of Attempted Assault in the Second Degree involving three separate Correction Officers.  As alleged in the indictment, NESMITH admitted that with intent to prevent the Correction Officers from performing a lawful duty, he caused physical injury to each Officer.  NESMITH faces an aggregate prison sentence of 3 ½- 7 years indeterminate which will run consecutively to his current 23  year determinate prison sentence by operation of law.
