Grand Jury Hands Up Indictments in Violent Felony Offenses

Auburn, NY - District Attorney Brittany Grome Antonacci announced today that the Cayuga County Grand Jury has returned an indictment against Darryl JONES, 58, and Michael BARSKI, 36, both of the City of Auburn, related to a robbery investigation that occurred on August 13, 2023 in the area of Orchard Street in the City of Auburn.  The indictment charges JONES with two counts of Robbery in the First Degree, Class B Armed Violent Felonies; one count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony; and one count of Assault in the Second Degree, a Class D Violent Felony.  BARSKI was indicted on one count of Assault in the Second Degree, a Class D Violent Felony for his role in the robbery investigation. The indictment alleges that on or about August 13, 2023, JONES forcibly stole property from the victim and during the commission of the crime, used or threatened the immediate use of a firearm. The indictment further alleges that both JONES and BARSKI, while acting in concert with each other, intentionally caused physical injury to the victim by means of striking him with a metal cane.   

 

Both individuals will be arraigned before Cayuga County Court at a date to be determined.  JONES faces a 25-year determinate sentence; BARSKI faces a 7-year determinate sentence.

 

The Cayuga County Grand Jury also handed up a multi-count indictment against Kevin HUNTINGTON, Jr., 19, of Red Creek, for his role in the August 11, 2023 multi-county car chase with police. The indictment charges HUNTINGTON with three counts of Attempted Aggravated Assault Upon a Police Officer, Class B Violent Felonies; Criminal Possession of Stolen Property in the Fourth Degree, a class E felony; Unauthorized Use of a Motor Vehicle in the Second Degree, a Class E Felony; Unlawful Fleeing a Police Officer in a Motor Vehicle in the Third Degree, a class A Misdemeanor; and Reckless Driving, an unclassified Misdemeanor. The indictment alleges that HUNTINGTON intentionally attempted to cause serious physical injury to three City of Auburn Police Officers by attempting to ram the stolen vehicle he was operating into the Officers’ vehicles at high speed.

 

The Grand Jury separately indicted HUNTINGTON for Assault in the Second Degree, a class D violent felony.  The indictment alleges that on August 9, 2023, at a location on Owasco Street in the City of Auburn, HUNTINGTON individually or acting in concert with an accomplice intentionally caused physical injury to another person by means of a dangerous instrument.

 

HUTNINGTON will be arraigned before Cayuga County Court at a date to be determined. He faces combined determinate sentences of up to at least 22 years.

 

All three individuals remain remanded without bail at the Cayuga County Jail.

As with any other individual accused of a crime, each defendant is presumed innocent until proven guilty.
