Guilty Plea in Armed Robbery at Auburn Smoke Shop

Auburn, NY- Acting District Attorney Brittany Grome Antonacci announced today that the case involving an armed attempted robbery at the Auburn Smoke Shop on New Year’s Eve resulted in a guilty plea.


MICHAEL CLARDY, 29, of the City of Auburn, pled guilty to the entire indictment pending against him, consisting of (2) two counts of Attempted Robbery in the First Degree, in violation of Penal Law Section(s) 110, 160.15[2], [4], and one (1) count of Criminal Possession of a Weapon in the Second Degree, in violation of Penal Law Section 265.03[3], all Class C Armed Violent Felonies, arising out of a December 31, 2021 arrest.


As alleged in the indictment, the defendant admitted to being armed with a loaded handgun when he attempted to forcibly steal property, specifically United States currency, from the Auburn Smoke Shop on December 31, 2021. The attempted robbery occurred inside of the Auburn Smoke Shop, located in the area of 67 Franklin Street in the City of Auburn. Following the attempted robbery, an eye witness followed defendant from the store to his residence on Franklin Street. Upon arrival, members of the Auburn Police Department located a loaded firearm, clothing matching the suspect’s description, and face masks outside of the defendant’s residence. Forensic analysis confirmed that defendant was the major contributor of DNA on the firearm. Video surveillance from inside of the Auburn Smoke Shop was also recovered, which depicted the robbery.


CLARDY faces a (7) seven-year determinate term of incarceration, followed by 5 years of post-release supervision.  He is scheduled to be sentenced before the Honorable Thomas G. Leone on June 9, 2022. CLARDY remains remanded without bail pending his sentencing.
