Auburn, NY - Acting District Attorney Brittany Grome Antonacci announced today that JULIAN BYER, 23, of the Village of Cayuga, and ENRIQUE TORRES, 26, of the City of Auburn, each pled guilty to one count of Robbery in the First Degree, in violation of Penal Law Section 160.15[3], a Class B Armed Violent Felony, arising out of a July 4, 2020 arrest.
As alleged in the indictment, both defendants admitted that they, along with their co-defendants, forcibly stole property from the victim, consisting of jewelry and United States currency. During the robbery the victim was struck multiple times and threatened with a loaded 9mm handgun. The robbery occurred on July 4, 2021 while in the area of Janet Street in the City of Auburn.
BYER faces a 15-year determinate term of incarceration, followed by 5 years of post-release supervision for his role in the robbery. TORRES faces a 13-year determinate sentence of incarceration, followed by a 5-year period of post-release supervision on the robbery count. TORRES also pled guilty to an unrelated charge of Criminal Sale of a Controlled Substance in the Third Degree, in violation of Penal Law Section 220.39, a Class B Felony, from February of 2020. He faces a ten-year determinate term of incarceration, followed by three years of post-release supervision on that count.
BYER is scheduled to be sentenced before the Honorable Thomas G. Leone on May 5, 2022; TORRES is scheduled to be sentenced on May 12, 2022.
