District Attorney Brittany Grome Antonacci announced that in decisions released today, the Appellate Division, Fourth Department affirmed several convictions secured by the Cayuga County District Attorney’s Office.
The Appellate Division affirmed the conviction and sentence of WILLIAM ROTH, who pled guilty to of Course of Sexual Conduct Against a Child in the First Degree before the Cayuga County Court on April 17, 2023. On August 10, 2023, the court sentenced ROTH to a determinate term of 15 years’ determinate prison plus 15 years’ post-release supervision. ROTH, a previously convicted sex offender, also pled guilty to Possession of a Sexual Performance of a Child (child pornography) and Failing to Report Change of Address as a registered sex offender. ROTH received concurrent sentences of 1-3 years for these convictions.
The Appellate Division also affirmed the convictions of COLE CHAPMAN. On May 18, 2023, CHAPMAN pled guilty to Robbery in the Third Degree. On February 13, 2023, CHAPMAN forcibly stole a jar of change from an Auburn resident. While jailed on that pending charge, CHAPMAN smashed the touchscreen of an inmate email kiosk at the Cayuga County Jail on March 28, 2023. CHAPMAN admitted to this act of vandalism when he pled guilty to Criminal Mischief in the Third Degree on May 25, 2023. On June 19, 2023, the court imposed indeterminate sentences of 11/3-4 years on each count to run concurrently. The court also issued an order of protection for the robbery victim and restitution to the Sheriff’s Office in the amount of $2,232.00.
Finally, the Appellate Division affirmed the conviction and sentence of EARL JACKSON, who pled guilty to Aggravated Family Offense and Criminal Contempt in the First Degree on September 30, 2022 and received a sentence of probation with four (4) months of jail on January 5, 2023.
